Welcome to The Smart DMS (“we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your use of our Data Management System (the “Service”). By creating an account, subscribing, or accessing the Service, you agree to comply with these Terms.

1. Eligibility

• You must be at least 18 years old or the age of majority in your jurisdiction.
• By using the Service, you represent that you have the authority to enter into a binding agreement.

2. Account Registration

• You are responsible for maintaining accurate account information and keeping your login credentials secure.
• You agree not to share your account or allow unauthorized use.

3. Subscriptions and Payments

• The Service is provided on a subscription basis. Fees, billing cycles, and renewal terms are displayed at checkout.
• Subscriptions automatically renew unless canceled prior to the renewal date.

• Failure to complete payment may result in suspension or termination of your access.

• You grant us the right to use anonymized and aggregated data to improve our services.

6. Service Availability

• We strive to provide continuous availability but do not guarantee uninterrupted access.
• We may perform scheduled or emergency maintenance that may temporarily affect access.

7. Termination

• You may cancel your subscription at any time via your account settings.
• We may suspend or terminate your account if you violate these Terms or fail to pay subscription fees.
• Termination does not relieve you of any outstanding payment obligations.

8. Limitation of Liability

• To the fullest extent permitted by law, we are not liable for indirect, incidental, or consequential damages arising from your use of the Service.
• Our maximum liability is limited to the amount you paid in subscription fees during the three months preceding the claim.

9. Changes to the Terms

• We may update these Terms from time to time.
• Material changes will be communicated via email or through the Service. Continued use after changes means you accept the revised Terms.

10. Governing Law

• These Terms are governed by the laws of Kenya.
• Any disputes shall be resolved in the courts of Kenya.
